Built in 1732, the courthouse is one of the oldest surviving in the United States and is a registered National Historic Landmark. The building served as Delaware's first court and state capitol. It was here, on June 15, 1776, that representatives from New Castle, Kent, and Sussex counties declared their independence from both Pennsylvania and Great Britain, effectively creating the state of Delaware. The first state constitution was adopted here shortly after on September 20, 1776. The capital was later moved to Dover in 1777. The New Castle Court House also holds significance for its role in the Underground Railroad. Significant events took place at the New Castle Court House involving slavery and the Underground Railroad, including the trials of abolitionists Thomas Garrett and John Hunn. In 2003, the New Castle Court House was designated as a National Historic Underground Railroad Site by the U.S. Department of Interior. Visitors can explore exhibits detailing Delaware's colonial court and assembly, as well as the state's involvement in the Underground Railroad and the stories of abolitionists. The museum also features a special exhibit called "We the People...The Right of Trial by Jury". Guided tours are available, providing insights into the building's history and its importance to the state.
